Federal Mine Safety and Health Review Commission
Publishes Final Rule

Michael F. Duffy, Chairman of the Federal Mine Safety and Health Review Commission, announced today the Commission's publication of a final rule revising many of the Commission's procedural rules, and regulations implementing the Equal Access to Justice Act and the Privacy Act. "We are making these changes in a continued effort to ensure the just, speedy, and inexpensive determination of all proceedings before the Commission," Chairman Duffy stated.

The revisions set forth in the final rule will take effect on October 3, 2006, and will apply to cases initiated after that date. In addition, the final rule will apply to proceedings pending on October 3, 2006, except to the extent that such application would be infeasible or unfair, in which event the former rules would apply.

The Commission's final rule is published in the August 4, 2006 Federal Register. A link to the rule appears on the Commission's website at http://www.fmshrc.gov under the heading "What's New."
