Access Constraints:  Files may be viewed only in the Commission’s headquarters office and may not be removed from such premises.  The standard copy fee for documents copied at the Commission is 15 cents per page.  Files may have to be obtained from off-site locations.  Files are retained or destroyed in accordance with the Commission’s Records Disposition Authority.

Purpose:  The Federal Mine Safety and Health Review Commission provides trial and appellate review of cases arising under the Federal Mine Safety and Health Act of 1977, 30 U.S.C. Section 801 et seq. (2000), and its amendments, including the Mine Improvement and New Emergency Response Act of 2006, PL 109-236 (S 2803) (MINER Act).  Official case files store documents used by Commission Administrative Law Judges and the Review Commission in its review of such cases.
