Section 301 of the Notification and Federal Employees Antidiscrimination and Retaliation Act of 2002 (the “No Fear Act”) requires each federal agency to post summary statistical data pertaining to complaints of employment discrimination filed against the agency by employees, former employees and applicants for employment for each quarter of the current fiscal year and the year-end data for the past five years.
The Federal Mine Safety and Health Review Commission has no reportable activity for the past five years through the first quarter of fiscal year 2009. In the second quarter of fiscal year 2009, an individual filed a complaint alleging discrimination based on sex, race and retaliation. That complaint was settled, resolved and terminated in the second quarter of fiscal year 2009. The investigation lasted 32 days. The Commission has no reportable activity for the third and fourth quarters of fiscal year 2009, and the first quarter of fiscal year 2010.
