CONSIDERED: The Commission will consider and act upon the following in open session: Secretary of Labor v. Cargill Inc., Docket No. LAKE 2022-0285 and LAKE 2023-0013 (Issues include: (1) whether substantial evidence supports the Judge’s determination that the operator did not violate the mandatory safety standard at 30 C.F.R. § 57.11051(a); and (2) whether the Judge erred in concluding that, even if a violation of section 57.11051(a) had been established, a lack of notice did not support the assessment of a penalty).
