On December 28, 2010, the Commission published a final rule which set forth procedures for simplified proceedings. The Commission implemented the simplified proceedings rule as a pilot program. After evaluating the pilot program, the Commission has determined that withdrawal of the simplified proceedings rule is necessary at this time.

This final rule is effective November 25, 2019 without further action, unless adverse comment is received by November 12, 2019. If adverse comment is received, the Commission will publish a timely withdrawal of this direct final rule in the Federal Register while the Commission considers appropriate action with respect to its simplified proceedings rule.

On September 30, 2019, the Commission issued its decision in Solar Sources Mining, LLC, Docket No. LAKE 2017-52.  

On September 30, 2019, the Commissioners unanimously appointed Glynn F. Voisin to serve as the Chief Administrative Law Judge of the Commission.  Judge Voisin comes to the Commission after a distinguished career as a Chief Administrative Law Judge and Administrative Law Judge for other federal agencies.

On September 26, 2019, the Commission issued its decision in M-Class Mining, LLC, Docket No. LAKE 2012-519.  

On September 19, 2019, the Commission granted the Secretary of Labor's petition for discretionary review of Docket No. LAKE 2019-0087-R.  

On August 28, 2019, the Commission granted the petition for discretionary review filed by the Secretary of Labor for Docket Nos. VA 2018-0103, VA 2018-0104.  

On August 13, 2019, the Commission issued its decision in Richmond Sand & Stone, LLC, Docket No. YORK 2018-31-M

On July 30, 2019 the Commission issued a Direction For Review in Hopedale Mining LLC, Docket No. LAKE 2019-0149.

On July 11, 2019 the Commission issued its decision in Sims Crane, Docket No. SE 2016-81.

Marco M. Rajkovich, Jr., of Kentucky, was sworn in today as a Commissioner of the Federal Mine Safety and Health Review Commission for a term expiring August 30, 2024, vice Robert F. Cohen Jr., term expired. He has also been designated by the President as Chairman.  Chairman Rajkovich was nominated by President Trump on January 16, 2019, and confirmed by the Senate on March 14, 2019.

William I. Althen, of Virginia, was sworn in today as a Commissioner of the Federal Mine Safety and Health Review Commission, reappointed for a term of six years expiring August 30, 2024.  He was nominated by President Trump on January 16, 2019, and confirmed by the Senate on March 14, 2019.

Arthur R. Traynor III, of the District of Columbia, was sworn in today as a Commissioner of the Federal Mine Safety and Health Review Commission for a term expiring August 30, 2022, vice Patrick K. Nakamura, term expired. He was nominated by President Trump on January 16, 2019, and confirmed by the Senate on March 14, 2019.

The Federal Mine Safety and Health Review Commission is an independent adjudicative agency that provides administrative trial and appellate review of legal disputes arising under the Federal Mine Safety and Health Act of 1977.
