On May 8, 2023, the Commission issued a decision in Secretary of Labor on behalf of Tara Otten v. Continental Cement Company, LLC, Docket No. CENT 2021-0013-D.

On December 20, 2022, the Commission issued its decision in Consol Pennsylvania Coal Company, LLC, Docket No. 2019-0094.  

The President has designated Commissioner Jordan to be the Chair of the Federal Mine Safety and Health Review Commission.  

Commissioners Mary Lu Jordan and Timothy J. Baker were sworn in as Members of the Commission.  Four of the five Commission seats are now occupied. 

On September 29, 2022, the Senate confirmed the President's nominations of Mary Lu Jordan and Timothy Baker to be Members of the Federal Mine Safety and Health Review Commission.  

On August 24, 2022, the Commission issued its decision in Peabody Midwest Mining, LLC, Docket No. LAKE 2019-0023 et al.  

Moshe Z. Marvit currently serves as a Supervisory Attorney-Advisor in FMSHRC’s Pittsburgh field office.  Prior to coming to FMSHRC, he worked in private practice, representing the United Steelworkers, and employees in pension and discrimination matters.  Marvit has also served as a member of the faculty of the University of Pittsburgh School of Law, the Duquesne University School of Law, the Pennsylvania State Unemployment Compensation Advisory Council, and the Steel Valley Authority.  He received his JD from Chicago-Kent College of Law, where he also earned a Certificate in Labor and Employment Law.  He has an M.A. from the University of Chicago, an M.A. from Carnegie Mellon University and a B.A. from the Pennsylvania State University.  He lives in Pittsburgh, Pennsylvania with his wife and son.
